1. These Terms and Conditions (Terms) constitute a legally binding agreement between Adelaide Airport Limited (AAL, we or us) and you (and, if applicable, any person who uses your booking to park a vehicle) (collectively, you).

2. Each time that you bring your vehicle into the car park, you do so subject to these Terms. Where you have utilised AAL’s online booking system the Online Parking Terms and Conditions, except clauses 7.1, 7.3, 7.4, 7.5, 7.6, 8.1, and 8.3, also apply. 3. When you park and leave your vehicle in the car park, you do so at your own risk and you remain responsible for your vehicle and any property in or on it.

4. You must produce either your parking access card or permit when requested to do so by AAL. Permits (where provided) must be clearly displayed within the vehicle at all times while within the designated car park.

5. You must park your vehicle within the limits as defined by lines painted on the surface of the parking area where marked and comply with all signs erected in the car park. You must comply with any directions or instructions we give you. If you breach any of these requirements, you must pay liquidated damages of $100, in addition to any other money you owe us, before you can remove your vehicle from this car park.

6. We have a general lien over, and the right to retain, your vehicle as security for any money which you owe us. If you fail to pay any money you owe us, we may sell your vehicle after 30 days to recover the money you owe us. We may sell your vehicle in such manner as we think fit in our absolute discretion and we are not obliged to obtain the best sale price for it.

7. You must not park your vehicle so as to obstruct or permit the obstruction of the free passage to, or the use of, this car park. We reserve the right to remove any obstructing vehicle. We will not be liable for any damage to your vehicle, persons or property by such removal. You will immediately pay us any costs we incur in connection with such removal.

8. Except to the extent required by law, we will not be liable for: (a) the safe custody of any vehicle in the car park; or (b) the delivery of your vehicle to any person, whether that person has authority to take it or not; or (c) any theft loss or damage whatsoever to any vehicle or its accessories or contents; or (d) any damage to your property, injury to you or your death while you, your vehicle or your property person is in this car park or while you are entering or leaving this car park.

9. You release and indemnify us from any claim against us or expense incurred by us arising from your use of the car park or from us removing your vehicle from it.

10. You must ensure that your parked vehicle is securely locked and the ignition key removed.

11. You must not litter the car park, or allow your vehicle to spill or leak oil in it.

12. Vehicles with trailers and oversized vehicles are not permitted in the car park without the prior consent of AAL. You may request the consent of AAL to park an oversize vehicle or vehicle with a trailer in writing to [email protected]. Such requests will be considered by AAL within 3 business days and where approved you will be notified by email. Where consent has been given in accordance with this clause 12, vehicles with trailers and oversize vehicles must not park across any greater than two (2) standard parking bays.

13. We may issue you either an access card (Card) or permit (Permit) to access the car park.

14. AAL reserves the right to request additional information to evidence your active employment on the AAL Terminal Expansion site.

15. A Card / Permit is issued to you and cannot be transferred. If you have a change of name after the submission of this application you must notify the Car Park Office within 30 days and complete the relevant forms.

16. The Card / Permit must not be altered in any way and remains the property of AAL at all times.

17. The Card / Permit can only be used by you in the course of your approved duties. The Card / Permit does not constitute an authority to enter the car park for any other purpose.

18. Cards / Permits which are damaged, lost or stolen must be reported as soon as possible to the AAL Car Park Office on 08 8154 9466.

19. Should your employment details change and you have no further need for the Card / Permit, AAL must be notified immediately and the Card / Permit must be returned within 7 calendar days.

20. AAL may alter the Terms at any time at its absolute discretion. Any amendment to the terms and conditions will be notified to you.

21. AAL reserves the right to suspend the further issue of Cards / Permits to you where you have not returned Cards / Permits which have expired or are no longer required.

22. Replacement of lost or damaged Cards / Permits will require a fee of $25.00.

23. The Card / Permit will only be valid between the dates specified and any extension will require the agreement of AAL.

24. You must comply with the limitations of use including restrictions on times and days for which a vehicle may be parked. Failure to comply will be considered a breach of these Terms.

25. You must comply with any directions or instructions given by AAL in relation to the carpark.

26. These Conditions of Use will exclude us from liability to the extent permitted by law. Our liability for breach of any term or guarantee imposed by law (including the Australian Consumer Law) that cannot be excluded, restricted or modified is limited to the extent permitted by law to: if the breach relates to services, the supplying of the services again, or the payment of the cost of having the services supplied again; and if the breach relates to goods, the replacement of the goods or the supply of equivalent goods; the repair of such goods; the payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired.

27. If any part of these Conditions of Use is illegal or unenforceable, that part is to be disregarded, and its removal will not affect the rest of the conditions.

28. In these Conditions of Use, references to: (a) “we”, “us” and “our” means Adelaide Airport Limited ACN 075 176 653, ABN 78 075 176 653 of 1 James Schofield Drive Adelaide Airport SA 5950 its employees, agents and independent contractors; (b) “you” means the person using, or intending to use this car park; and (c) “your vehicle” includes a vehicle driven, or intended to be driven, by you into this car park.
